The Judiciary and State Administration in the Light of New Technology Law

Grynhoff Woźny Maliński has been invited by CBKE [Wrocław University's Research Centre for Legal and Economic Issues Related to Electronic Communications] to take part in an academic conference on 'The Judiciary and State Administration in the Light of New Technology Law' as the Expert Partner.
The conference will be held on 21-22 September 2009 in Wrocław. Its aim is to provide scholarly debate on issues connected with new technology law in the broad sense. The organisers' priority is to enable participants to discuss topics related to the application of new technologies in the judiciary's practice, as well as to highlight the role played by new technologies in state administration.
During the conference, the Firm will be represented by Jacek Wilczewski, an attorney-at-law and partner, and Krzysztof Siewicz, a doctoral student at Leiden University (Holland). They will give two lectures:
- Local Government Intervention in the Telecommunications Sector
This lecture will focus on cases of local government intervention in the telecommunications sector, including operational programmes financed by the ERDF in 2007-2013, the permissibility of public assistance, and the utilisation of radio frequencies. The presentation will cover the basic rules for embarking on such intervention which implement the principles of subsidising and proportionality, minimising disruptions of competition, technological neutrality and open access, and key problems arising from restrictions in system-related regulations.

- The Obligation to Apply Open Standards when Computerising Entities that Carry out Public Tasks
The lecture will focus on the provisions of the Act on Computerisation and public procurements law and confront them with the provisions of the Constitution, particularly the principle of equality before the law. Practical methods of fulfilling the obligation in question will be presented, and an attempt will be made to determine what exactly it involves.
